How can I quickly retrieve state-specific laws governing employment of aliens?
Q: Our firm represents a corporation that does business in several states and has sought my advice about the employment of aliens. I can find treatises on federal immigration law, but I suspect the states at issue have additional requirements and penalties for unauthorized employment. Is there an easy way to retrieve such laws and regulations in these states?
A: Rather than dig into the various state statutory and administrative codes, start with the newly released State Immigration Employment Compliance Handbook database (IMSTATE). IMSTATE contains the full text of the State Immigration Employment Compliance Handbook, authored by nationally known immigration law experts Austin T. Fragomen Jr., Careen Shannon, and Daniel Montalvo. This resource is a state-by-state guide to the existing state laws and regulations aimed at preventing unauthorized employment of noncitizens in the United States. It is especially useful when advising corporations that operate in multiple states.
Each chapter is devoted to one of the 26 states with such laws and regulations; you can use the Table of Contents service to quickly browse the materials for a specific state and retrieve sections by clicking section names. Sections may include overviews, full-text authorities, citations and Web references, and practice tips. The appendix contains a convenient chart that compares the state laws governing employment verification and employer sanctions. IMSTATE is current through February 2009.
