Markman orders—with all the trimmings

When you retrieve a case on Westlaw, you also retrieve any number of enhancements, research tools, and links to related materials.

That goes double for a Markman order.

Like any other federal district court case, a Markman order (an interlocutory order from a Markman hearing, in which a federal district court construes the claims of one or more patents) contains a ResultsPlus list, KeyCite information, links to related filings, and other time-saving and research-strengthening enhancements.

And as part of Westlaw Patents, the same Markman order may also contain links for each underlying patent, providing quick access to the following:

  • the underlying patent document and attachments
  • U.S. patent family tree
  • patent file history
  • office actions and related history
  • claims versions

Each underlying patent may contain a KeyCite status flag, links to prior art, and a link to the patent examiner's profile.

You can retrieve Markman orders by searching the Markman Orders (MARKMAN-ORDERS) or Markman Orders and Filings (MARKMAN-ALL) database or by clicking Markman Order Version in selected KeyCite history results. To retrieve claim construction charts from Markman proceedings, search the Claim Construction Charts Court Filings database (MARKMAN-CLAIMCHT).
