Patent claims construction charts: Stay on top of these crucial litigation documents

If you assist professionals involved in patent infringement litigation, let them know about the following resources recently released on Westlaw:

  • Claim Construction Charts Court Filings database (MARKMAN-CLAIMCHT): In a patent infringement case, lawyers are typically required to submit a jointly prepared chart that identifies the allegedly infringed claims and proposed claim constructions. MARKMAN-CLAIMCHT contains selected charts filed in U.S. district courts—essential reading if your client's patent case involves similar claims. Coverage begins with 2005.
  • Patent district court filing rules databases: Detailed requirements for patent claims construction charts are provided in local district court rules. An easy way to retrieve the rules for your state is to use one of nine new state-specific databases that condense the governing rules for a specific patent procedure into a single document (much like KeyRules databases). Similar databases for the International Trade Commission and the U.S. Patent and Trademark Office (USPTO) are also available. The identifier for each state database is PATRULES-XX, where XX is the state's two-letter postal abbreviation.
