ABA-ERISASUB: when the insurer comes knocking
Before the ink is dry on a personal injury settlement, your firm may find itself facing another dispute: an insurer's subrogation claim under the Employee Retirement Income Security Act of 1974 (ERISA). "The average practitioner may be forced to deal with ERISA on subrogation claims despite the fact that his or her practice has nothing to do with ERISA," writes longtime ERISA practitioner Robert Hoskins. Robert E. Hoskins, Subrogation Rights Under ERISA-Governed Health Plans, S.C. Law., Sept. 2005, at 31.
If that average practitioner is your firm's newest associate, how does he or she get up to speed?
A good place to start is the ERISA Subrogation database (ABA-ERISASUB), recently released on Westlaw. ABA-ERISASUB contains the full text of ERISA Subrogation, an American Bar Association publication by Thomas H. Lawrence and John M. Russell that, in 10 short chapters, lays out the basics of litigating cases involving health and disability plans covered by ERISA. The chapters are full of cited cases, statutes, and other authorities, with links to the full-text sources.
