ABI treatises: A focused approach to bankruptcy research

Bankruptcy law can overwhelm the newcomer. One could write an entire book about almost any procedural stage or class of filers!

Thankfully, the American Bankruptcy Institute (ABI) has done just that.

ABI has produced several single-topic publications on formidable areas of bankruptcy procedure (e.g., first-day motions and preference defense), on particular classes of filers (e.g., auto suppliers and telecommunications firms), and on other aspects of bankruptcy practice. At least 22 of these publications have been released as databases on Westlaw, including the following databases released since March 2009:

  • ABI's Bankruptcy Appeals Manual (ABI-BANKAM)
  • ABI's Pension Manual (ABI-PENSION)
  • Auto Supplier Insolvencies and Bankruptcies (ABI-AUTO)
  • Bankruptcy and Its Impact on Intellectual Property (ABI-BANKIP)
  • Bankruptcy: A Survival Guide for Lenders (ABI-BASGL)
  • Creditors' Committee Manual (ABI-CCOM)
  • Cross-Border Insolvency in the United States (ABI-CROSS)
  • Pre-Bankruptcy Planning for the Commercial Reorganization (ABI-PBPCR)
  • Retention and Payment (ABI-RETPAY)
  • Thorny Issues in Consumer Bankruptcy Cases (ABI-TICBC)

An ideal starting point for searching these ABI treatises is the tabbed Bankruptcy Practitioner page on Westlaw. You can identify most of the available ABI treatise databases by viewing the ABI Materials section in the lower-right corner of the page (if necessary, click Show all to expand the section). You can also use this page to search one or more ABI publications simultaneously and to access the Table of Contents service for the databases for which it is available. ABI treatise sections typically contain links to the full text of cited sources.

ABI was founded in 1982 to provide Congress and the public with unbiased analysis of bankruptcy issues. It describes itself as "the largest multi-disciplinary, non-partisan organization dedicated to research and education on matters related to insolvency."
