Judicial constructions of patent terms—no search required

View Construed Terms link on Patent Counsel pageSuppose you want to know how patent judges have construed a technical term (e.g., key operable locking head) that sometimes appears in patents and patent applications. Is there an easy way to find the exact judicial construction?

There's a very easy way: At the tabbed Patent Practitioner, Patent Counsel, or Westlaw Patents page on Westlaw, click View Construed Terms. (A Construed Terms link is also displayed under IP Tools on the tabbed Westlaw IP page.) An alphabetical index of terms construed in Markman orders is displayed. When you find your term, click its link. Westlaw automatically runs a field-restricted search for the term in the Markman Orders database.

  • database names
  • database identifiers
  • knowledge of field restrictions
  • Terms and Connectors search expertise

To select one of these tabbed pages, click Add a Tab. Click Add Westlaw Tabs, and then click Patent Practitioner, Patent Counsel, Westlaw Patents, or Westlaw IP. If you choose, you can drag this feature from the Patent Practitioner, Patent Counsel, or Westlaw Patents page to other tabbed pages.
